urther to trademark infringement dispute pending between Lidl and Tesco of which I have shared here recently, Marks & Spencer filed an infringement action against Aldi based on its registered design taken for gin product. Marks & Spencer sued Aldi for copying its registered designs of the light-up Christmas gin bottles. Marks & Spencer claimed that Aldi could have produced a gin in a differently shaped bottle such as a Christmas tree with features of sound, but instead opted for a bottle entailing the same features as of M&S version. Respectively, Marks & Spencer has to prove that the gin bottle produced by Aldi creates the same overall impression to be successful in its claim.
