Description

The Court of Rome granted preliminary injunction decision against the creator of an NFT displaying not only the image of a football player but also reproducing trademarks owned by a well-known football team in Italy, Juventus FC, without its prior consent. This seems to be the first known case led to a PI decision granted by a European Court confirming that the exploitation of a third party’s trademark in the realm of NFT world without the trademark owner’s prior consent would create an act of trademark infringement thus it was prone to be ceased by a PI decision.
